Americans with Disabilities Act (ADA)

The Americans with Disabilities Act, known as the ADA, is a federal law that prohibits discrimination against qualified applicants and employees based on their disabilities. The ADA also requires employers to provide reasonable accommodations to qualified applicants and employees with disabilities, unless it would impose an undue hardship on the organization.

Under the ADA, it’s unlawful to discriminate against an individual with a disability in all employment practices and activities, including recruiting, hiring, termination, pay, benefits, training, job assignments, promotions and lay-offs. The ADA also prohibits discrimination on the basis of pregnancy-related impairments. Organizations that violate the ADA can face serious fines, penalties and fees.

In its guidance on the ADA during COVID-19, the Equal Employment Opportunity Commission (EEOC) has said that employers are expected to comply with their obligations under the ADA, while following the most current guidelines from the CDC or state and local public health officials.
